Jackie O drops $82m bombshell in messy radio break-up

There has been yet another twist in the implosion of the Kyle and Jackie O Show, with co-host Jackie Henderson starting her own Federal Court action.

Henderson has filed a lawsuit against radio company ARN alleging the termination of her $100 million morning radio contract was a breach of the Fair Work Act.

It came just days after her former co-host, Kyle Sandilands, also sued the pair’s his former employer ARN – owner of KIIS and Gold radio stations – over claims his lucrative contract was invalidly terminated in March because there was no serious misconduct.

Henderson’s case, filed in the Federal Court on Tuesday, alleges the termination of her $100 million contract “constituted adverse action”. It seeks compensation of at least $82 million.

The action states that Henderson sent a complaint letter to ARN subsidiary Commonwealth Broadcasting Corporation (CBC) stating she could not “continue to work” with Sandilands after their on-air blow-up on February 20.

The letter raises Henderson’s concerns about “psychosocial health and safety and bullying” related to Sandilands’ conduct “on and prior to February 20, 2026”.

The 51-year-old said making the complaint was within her rights as an employee. But she said her contract was subsequently terminated, in a breach of the Fair Work Act.

Henderson also alleges “misleading and deceptive statements under the Australian Consumer Law” by ARN when it announced the termination of her contract on March 3. She further argues that tearing up the contract “amounted to a repudiation of that agreement”.

Henderson is claiming at least $82.25 million in compensation plus interest, legal costs and for ARN to face a court fine.

ARN, which has a market value of $90 million, said it disputed the claims and intended to fight them.

The announcement of another costly court battle is more bad news for the struggling radio company, which popped most of its eggs in the Kyle and Jackie O Show basket in late 2023, signing the stars to 10-year, $100 million contracts.

Instead, ARN faces payouts totalling more than $150 million should it lose the cases.

Shares in the company have fallen at least 66 per cent since the 10-year deal was signed in November 2023. It shed 3.4 per cent in early trade on Tuesday to hit 28 cents.

Sandilands’ own case had its first hearing in the Federal Court last week. He argues that ARN’s decision to end his contract on the grounds of “serious misconduct” was invalid because there was no serious misconduct.

“It feels like I didn’t do anything different than I’ve been doing for 25 years,” the 54-year-old shock jock said outside court last Friday.

Justice Angus Stewart has directed both parties to file further documents before the matter returns to court in April.

The Kyle and Jackie O Show had enjoyed years of success before it came to abrupt end after Sandilands slammed Henderson for looking into former prince Andrew Mountbatten-Windsor’s horoscope.

“You’re off with the fairies … every segment, every time you’ve spoken, you don’t even know what’s going on,” he told her during their February 20 broadcast.

Sandilands was suspended on March 3 and issued a breach notice for serious misconduct.

He has consistently denied breaching the terms of his contract.

Outside court on Friday, Sandilands said he regretted his comments to Henderson but that he’d done nothing different to his usual behaviour.

“We’ve had blow-ups before … We just get over it, usually. So I think this has all turned into quite a circus,” he said.
