This Privacy and Cookie Policy (Policy) explains how we collect, use, disclose, store, and protect personal information, including our obligations and your rights in respect of our dealings with your personal information. By using Solstice Media services you are consenting to your personal information being used in accordance with this policy, unless you expressly request us to cease using your personal information.

If you access our digital services, the specific Solstice Media entity operating that service is identified on the service itself. If you provide personal information offline, we will notify you of the collecting entity at the time of collection.

1. Introduction

We comply with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth) (Privacy Act), the EU General Data Protection Regulation (GDPR), and the California Consumer Privacy Act (CCPA) where relevant. Not withstanding that our services are directed at individuals domiciled in Australia. We do not knowingly target individuals outside Australia. To the extent we are legally required to comply with applicable overseas privacy regulations in relation to any personal information we collect, we will comply with those regulations.

We adopt reasonable measures to protect your personal information and ensure it is used only for legitimate purposes. Where applicable, we may rely on media, employee, or other exemptions under the Privacy Act.

This Policy should be read alongside any Terms of Use and our Tracking and Targeting Policy for digital services.

2. Personal Information We Collect

“Personal information” includes any information or an opinion, whether true or not, about an individual who is identified or is reasonably identifiable.

The types of personal information we may collect include but are not limited to:

  • Your name, date of birth, gender
  • Contact information (postal address, email, phone number)
  • Information about your use of our websites and subscriptions to our publications
  • Payment or financial details
  • Location data, photographs, or other identifiers

Sensitive information

We do not generally collect sensitive information (such as racial or ethnic origin, political or religious beliefs, sexual preferences, health information, or criminal records) about you. If sensitive information is disclosed during the course of your interaction with us it will only be collected with your consent, or otherwise in accordance with the Privacy Act.

3. How We Collect Personal Information

We will collect and hold your personal information in a fair and lawful manner, and not in an intrusive way. Where it is reasonably practical to do so, we will collect your personal information directly from you. We collect your personal information:

  • Directly from you when you interact with our websites, apps, newsletters, surveys, competitions, events, podcasts, YouTube or social media;
  • Via registration for a Solstice Media account, including optional connections with third-party login providers (e.g., Google, Facebook);
  • From other Solstice Media entities and related companies; and
  • From third parties, such as social networks, recruitment platforms, advertisers, analytics providers, and government agencies, as authorised or permitted by law.

However, in certain cases we may collect personal information from publicly available sources and third parties, such as suppliers, recruitment agencies, contractors, our clients and business partners.

If we collect personal information about you from a third party we will, where appropriate, request that the third party inform you that we are holding such information, how we will use and disclose it, and that you may contact us to gain access to and correct and update the information.

We may also collect information about how you access, use and interact with our website. We do this by using a range of tools such as Google Analytics and Adobe Analytics. This information may include:

  • Information about the location from which you have come to the site and pages you have visited; and
  • Technical data which may include IP address, types of devices you are using to access the website, device attributes, browser type, language and operation system.

We may also collect metadata, including browser type, device information, IP address, operating system, referrer URL, and usage patterns, to improve our services, enhance security, and personalise content and advertising.

4. How We Use and Disclose Personal Information

We collect, hold, use and disclose personal information for purposes related to our services, including but not limited to:

  • Providing our users with products and services to manage our relationship with you, including in relation to our subscription service, competitions, authentication and payments;
  • Providing Solstice Media products and services such as news, editorial content, subscriptions, and improving our products and services;
  • Personalising and customising your experience when you visit our website to present you with content, goods and services that likely to be of interest to you, and to personalise communications;
  • Administering events, competitions, surveys, and promotions;
  • Marketing and promotional communications for our brands and selected third parties (if consented to);
  • Customer service, fraud prevention, quality control, research, and analytics;
  • Compliance with legal obligations, to assist government and law enforcement agencies and regulators, or to protect health, safety, or rights of individuals; and
  • Contacting you, for example, to respond to your queries or complaints, or if we need to tell you something important.

We may share personal information with:

  • Other Solstice Media entities and related companies;
  • Service providers, contractors, professional advisers, and business partners;
  • Third-party advertisers and sponsors; and
  • Regulatory bodies, law enforcement, or other authorities as required by law.

If we disclose information to a third party, we generally require that the third party protect your information to the same extent that we do. Wherever possible, we will de-identify personal information before sharing it with third parties.

We may disclose your personal information in our publications, for example where you provide us with a comment to publish in connection with one of our stories, we may publish your name.

From time to time, we may engage an overseas recipient to provide services to us, such as cloud-based storage solutions.  Information may be stored in Australia or overseas (including the US, NZ, Malaysia, the Philippines, and Singapore) by trusted service providers under appropriate safeguards.

In using our services, you consent to your personal information being stored or processed outside Australia in the countries listed above. We will not use or disclose your personal information for any other purpose unless you have consented to that use or disclosure, or the relevant use or disclosure is otherwise permitted by the APPs or some other law.

5. Direct Marketing

We will use your personal information to provide you with our publications, and offer you products and services we believe may interest you, but we will not do so if you tell us not to. These publications, products and services may be offered by us, our business partners or other service providers. We may utilise the services of third parties to assist us with undertaking our direct marketing activities.

We may send you direct marketing communications about products and services across the Solstice Media group that we consider may be of interest to you, in compliance with applicable marketing laws including the Spam Act 2003 (Cth).

You acknowledge and agree that your personal information may be shared within the Solstice Media group for the purposes disclosed in this Policy.”

Where you receive electronic marketing communications from us or our related bodies corporate, you may opt out of receiving further marketing communications by following the opt-out instructions provided in the communication.

Provided that you have not unsubscribed or otherwise opted out, we may use your information for direct marketing:

  • where you have agreed to receive direct marketing from us; or
  • where you have engaged with us directly, and we believe that you would reasonably expect to receive direct marketing from us.

You will be given the opportunity to “opt out” from receiving communications from us, our related bodies corporate, or from third parties that send communications to you in accordance with this Privacy Policy. For example, you will be given the option to unsubscribe from email newsletters, emails, SMS communications and other marketing or promotional material sent by us. You may also opt-out of ‘interest based advertising’ (also known as ‘online behavioural advertising’) (interest based advertising) as set out in our Cookies and Tracking Technology section.

Note that if you opt-out of direct marketing messages from us, we may still communicate with you from time to time for other purposes, including where we:

  • respond to any correspondence you send us;
  • provide you with invoices;
  • engage with our contractors and suppliers; or
  • are legally required to provide you with notice of certain matters.

6. Journalism activities

Many of our businesses involve conducting journalism.  We are publicly committed to observe the Standards of Practice of the Australian Press Council, which deal with privacy in the context of the activities of our media organisation.

Under section 7B(4) of the Privacy Act, we may collect, hold, use and disclose personal information in a manner which is inconsistent with the APPs where we do so in the course of journalism.  There may accordingly be instances where we handle personal information inconsistently with this Policy in conducting journalism.

7. Cookies and Tracking Technologies

Solstice Media websites use cookies and similar technologies to:

  • Enhance user experience
  • Analyse usage patterns for service improvements
  • Personalise content, advertising, and offers
  • Enable social media sharing

8. Data Security

We will hold personal information as either secure physical records, electronically on our intranet system, in cloud storage, and in some cases, records on third party servers, which may be located overseas.

We maintain appropriate physical, procedural and technical security for our offices and information storage facilities so as to prevent any loss, misuse, unauthorised access, disclosure, or modification of personal information.  This also applies to disposal of personal information.

We further protect personal information by restricting access to personal information to only those who need access to the personal information do their job.  Physical, electronic and managerial procedures have been employed to safeguard the security and integrity of your personal information.

We will destroy or de-identify personal information once it is no longer needed for a valid purpose or required to be kept by law.

We take reasonable steps to protect your personal information against unauthorised access, modification, disclosure, or loss.

If a third party processes data on our behalf, we require contractual assurances that they will maintain the same level of protection.

9. Access, Correction, and Deletion

You may contact our Privacy Officer at the address listed below to request access to the personal information that we hold about you and/or to make corrections to that information, at any time.  On the rare occasions when we refuse access, we will provide you with a written notice stating our reasons for refusing access.  We may seek to recover from you reasonable costs incurred for providing you with access to any of the personal information about you held by us.

We are not obliged to correct any of your personal information if it does not agree that it requires correction and may refuse to do so.  If we refuse a correction request, we will provide you with a written notice stating our reasons for refusing.

We will respond to all requests for access to or correction of personal information within a reasonable time.

Our services are directed at individuals domiciled in Australia. We do not knowingly target individuals outside Australia. To the extent we are legally required to comply with applicable overseas privacy regulations in relation to any personal information we collect, we will comply with those regulations.

EU residents also have rights under the GDPR to:

  • Receive a copy of personal data in a portable format
  • Restrict processing of personal data
  • Request erasure of personal data

Californian residents have rights under the CCPA to:

  • Access collected data
  • Request deletion of personal data
  • Opt-out of the sale of data

10. Data Breaches

We do all we reasonably can do to ensure your data is collected, used and held securely in accordance with industry standards. We comply with the Australian Notifiable Data Breaches (NDB) Scheme and GDPR breach reporting requirements. If at any time we become aware of unauthorised access to or disclosure of personal information held by us and we consider this is likely to result in serious harm to any individual to whom the information relates we will follow the data breach notification requirements under applicable law including to notify the individual involved and the relevant regulator. If we become aware of a data breach that is likely to result in serious harm, we will promptly notify affected individuals and the Office of the Australian Information Commissioner (OAIC), in line with the NDB Scheme:

  • We will contain the breach and assess the risk
  • Notify affected individuals and regulators where required
  • Maintain records of breaches and remedial actions.

11. Anonymity

Where practicable, you may interact with Solstice Media anonymously or under a pseudonym. This is not possible where law requires identification or verification to provide services.

12. EU GDPR Compliance

We comply with the GDPR (Regulation (EU) 2016/679) to the extent that we collect the personal information of residents of the EU, and in the unlikely event that Solstice Media uses Cookies that store personally identifiable information.

Solstice Media Pty Ltd (ACN 105 598 187) is the data controller for the purposes of the GDPR.

Solstice Media will ensure that:

  • Consent is obtained prior to processing personal data
  • You can withdraw consent at any time
  • Personal data of EU residents is only transferred to countries with adequate protections, or where safeguards are in place
  • All data processing follows GDPR principles of transparency, purpose limitation, and data minimisation
  • Your consent is obtained prior to the setting of the cookies, your consent to the use of cookies can be provided by clear affirmative, positive action; rejecting the use of cookies will be an actual option in the sense that you can continue to access our website and its functions even if all but the essential cookies have been rejected; you can withdraw your consent at any time by changing the relevant settings; your consent is renewed every 12 months; we document your consent and store it securely; and we delete your personal data upon request.

In accordance with the GDPR, we will ensure that:

on becoming aware of a personal data breach, we will:

(i) attempt to contain it and assess the potential adverse consequences for individuals involved; and
(ii) if, after conducting an assessment, we consider that:
(A) there is a risk to an individual’s rights and freedoms as a result of the personal data breach, we will report the breach to the competent Supervisory Authority (SA) without undue delay and, where feasible, not later than 72 hours after becoming aware of the breach; and
(B) there is a high risk to an individual’s rights and freedoms as a result of the personal data breach, we will report the breach to the competent SA in accordance with the clause above and notify the individual affected without undue delay.

We will keep a record of all personal data breaches, regardless of whether or not they need to be reported to the SA.

We will not report a personal data breach in the event that, after conducting an assessment, we consider that the risk of harm to an individual’s rights and freedoms is unlikely.

A “personal data breach” for the purposes of the GDPR occurs whenever any personal data is lost, destroyed, corrupted or disclosed; if someone accesses the data or passes it on without proper authorisation; or if the data is made unavailable, for example, when it has been encrypted by ransomware, or accidentally lost or destroyed.

Additional Rights of Residents of the EU

In addition to the protections afforded under the Privacy Act and the APPs, if you are a resident of the EU, you have a number of express rights under the GDPR, including:

  • the right to receive personal data you have provided to us in a structured, commonly used and machine readable format, including the right to request that we transmit this data directly to another data controller.
  • the right to restrict the processing of your personal data in certain circumstances. This means that you can limit the way that we use your data (this right is an alternative to requesting the erasure of your data); and
  • the right to require us to erase your data in certain circumstances,
